It would be an easy win for the Tupas family this election beacuse of symapthy votes. The dismissal order is untimely. Much more, the situation was aggravated by the PNP's action at the capitol. Gen. Dulay's order of using the "shock and awe" style of attacking the capitol is a mistake for the reason that people inside were unarmed civilians exercising their right to peaceably assemble in order to adress their side and grievances to the government that they still support the governor. The "shock and awe" attack strategy can only be used when their is grave danger to life and limb, when you have something to rescue or when their is a hostage-taking activity inside. What's inside the capitol are not just ordinary civilians but professional persons, local officials elected by the people like Board Member Junjun Tupas (a lawyer and a graduate of the UP College of Law) and Mayor Boboy Tupas ( a PMAer, President of the Iloilo Mayor's Leage and President of his class in the PMA). These persons are not terrorists wherein Gen. Dulay would use the "Shock and Awe" strategy. In this situation, you have to use proper negotiations and give extra time for the governor to prove himself that indeed their was a TRO, not using force immediately in order to protect the image of the PNP for the reason that civilian authorites like our local officials are much higher than the military. Our local officials are elected by the people and we must afford them respect. Indeed, Gen. Dulay was "shocked and awed" that later on when his troops entered the capitol, there was really a TRO issued by the Court of Appeals 19th Division.

I think the reason behind Tupas' stay at the capitol -even with the remedy of getting the TRO- is that, whoever is in the capitol when the TRO is issued will be one to continue sitting there during the next 60 days.
I think this is also the reason why the opposite side was in a hurry to remove Tupas.
Had Tupas been removed, then the TRO becomes moot because the deed has already been done and there is nothing to restrain anymore.
